Terms of Service

These Terms of Service (“Terms”) govern access to and use of DonatorHive, a donor-management and fundraising platform operated by Balanced Basics LLC / DonatorHive (“DonatorHive,” “we,” “us,” “our”). By creating an account or using DonatorHive, you (“Organization,” “you,” “your”) agree to these Terms.

If you do not agree to these Terms, do not use DonatorHive.

1. Description of Service

DonatorHive is a software platform that allows nonprofit organizations to manage donor relationships, accept one-time and recurring donations through Stripe, generate donor communications and reports, and organize fundraising data. DonatorHive is a technology provider only. DonatorHive is not a charity, does not solicit donations on its own behalf, and is not a party to any donation transaction between a Donor and an Organization.

2. Eligibility

DonatorHive is intended for use by legally organized nonprofit or charitable organizations. By creating an account, you represent that:

  • You are authorized to act on behalf of the Organization you are registering
  • The Organization is a legitimate entity operating in good faith
  • All information provided during registration is accurate and current

DonatorHive reserves the right to refuse service, suspend, or terminate any account at its discretion, including if we determine an Organization does not meet these criteria.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@trydonatorhive.com if you suspect unauthorized use of your account.

4. Subscription and Billing

Pricing. DonatorHive is offered on a subscription basis. Current standard pricing is $89/month. Organizations that sign up through a referring sales representative’s link are billed $69/month, and that rate is locked for the life of that Organization’s subscription and will not increase due to future standard price changes, provided the subscription remains active and in good standing.

Billing Cycle. Subscriptions are billed monthly in advance through Stripe. By subscribing, you authorize DonatorHive to charge your designated payment method on a recurring monthly basis until you cancel.

Price Changes. DonatorHive may change standard subscription pricing at any time with notice. Price changes do not apply to Organizations with a locked referral rate, as described above, unless that Organization changes plans or its account is otherwise modified in a way that affects pricing.

Failed Payments. If a payment fails, DonatorHive may suspend access to the account until payment is successfully processed.

Cancellation and Refunds. See the separate Refund and Cancellation Policy, which is incorporated into these Terms by reference.

5. Donations and Stripe Connect

DonatorHive uses Stripe Connect to allow Organizations to accept donations directly. By connecting a Stripe account:

  • You authorize DonatorHive to facilitate the flow of donation transactions to your connected Stripe account
  • You agree to Stripe’s Connected Account Agreement and Stripe’s Services Agreement, which govern the actual movement of funds
  • DonatorHive does not hold, custody, or have access to donated funds. Funds are transferred directly through Stripe to your connected account
  • You are solely responsible for your Organization’s tax-exempt status, for issuing any tax-deductible donation receipts required by law, and for complying with applicable charitable solicitation laws in the jurisdictions where you solicit donations
  • DonatorHive is not responsible for delays, holds, or disputes related to fund transfers, which are governed by Stripe’s own agreements and policies

6. Acceptable Use

You agree not to use DonatorHive to:

  • Solicit donations fraudulently or misrepresent your Organization’s purpose, tax status, or use of funds
  • Upload or process donor data you are not legally authorized to collect or use
  • Violate any applicable law, including charitable solicitation registration requirements
  • Interfere with or disrupt the platform’s security or functionality
  • Use the platform to send unsolicited communications (spam) to donors or third parties
  • Reverse-engineer, resell, or white-label the DonatorHive platform without written permission

Violation of this section may result in immediate suspension or termination of your account without refund.

7. Intellectual Property

DonatorHive and all associated software, design, trademarks, and content are the property of DonatorHive and its licensors. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your Organization’s internal fundraising and donor-management purposes. You retain ownership of the donor data and content you upload to the platform.

8. Feature Suggestions and Feedback

If you submit feedback, suggestions, or feature requests through DonatorHive’s support or feedback tools, you grant DonatorHive a perpetual, royalty-free right to use, implement, and incorporate that feedback into the platform without obligation or compensation to you.

9. Disclaimers

DONATORHIVE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE AT ALL TIMES.

DonatorHive does not guarantee donation volume, fundraising outcomes, or the tax-deductibility of any donation processed through the platform.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DONATORHIVE AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST DONATIONS, LOST DATA, OR LOST PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

DonatorHive’s total liability for any claim arising from these Terms or use of the platform shall not exceed the amount you paid to DonatorHive in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold DonatorHive harmless from any claims, damages, or expenses (including reasonable attorney’s fees) arising from your use of the platform, your violation of these Terms, or your violation of any law or third-party right, including claims related to your Organization’s charitable solicitation practices or tax reporting.

12. Termination

You may cancel your subscription at any time through your account settings. DonatorHive may suspend or terminate your account for violation of these Terms, non-payment, or suspected fraudulent activity. Upon termination, your right to use the platform ends immediately; data export and retention are governed by our Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising from these Terms or use of DonatorHive shall be resolved through binding arbitration in Arizona, except that either party may seek injunctive relief in court for intellectual property or confidentiality violations. You waive any right to participate in a class action against DonatorHive.

14. Changes to These Terms

We may modify these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of DonatorHive after changes take effect constitutes acceptance of the revised Terms.
